On Tuesday, Omnicare unit and CVS Health Corp have been sued by the government of United States. They have been accused of billing fraudulent Medicare and more drug related programs for the disabled and older people without a valid prescription.
The justice department has joined the litigation by a whistleblower which accused Omnicare of violation of the False Claims Act for dispensing drugs illegally to many patients in the assisted facilities of living, to group homes for the people who have special needs and other facilities of long-term care.
As per the civil complaint in the federal court of Manhattan, Omnicare used to assign new numbers often to the prescriptions after the original ones had run out of refills.
The government had said that this allowed them to bill the Medicaid, Medicare and Tricare. These provide service to the military personnel and for many of the drugs. The billing was made under what the company had been internally referring it as the rollover prescriptions form the year 2010 to 2018.
A lot of the drugs had been anticonvulsants, antipsychotics and antidepressants which were meant for the treatment of serious conditions like depression, heart diseases and dementia. These drugs had a lot of side effects and required some supervision from the doctors as per the government.
The attorney has said that fundamental obligations of a pharmacy are to ensure that the dispensing of drugs happens only when it is under the supervision of the doctors who are monitoring these patients.
He added that Omnicare had put the health of a lot of people at risk particularly those who were disabled and elderly and were living in the care facilities.
